Terms of Use

The terms governing your use of this website.

Effective date: September 20, 2026

These Terms of Use govern your access to and use of ozarkmenshealth.com (the "Site"), operated by Ozark Health and Wellness, PLLC, doing business as Ozark Men's Health ("Ozark Men's Health," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The Site Is Informational, Not a Substitute for Care

The Site provides general information about our practice and services. It does not provide medical advice, diagnosis, or treatment, and using the Site does not create a clinician-patient relationship. A clinician-patient relationship is established only after you complete a medical evaluation with our practice.

No Medication Is Sold or Dispensed Through the Site

Nothing on the Site is an offer to sell medication, and no medication can be purchased, ordered, or obtained through the Site. A medical evaluation with a licensed clinician and a valid prescription are required before any medication is prescribed. When medication is prescribed, it is dispensed by a licensed pharmacy — not by Ozark Men's Health. Fees described or quoted on the Site are for professional services and membership, not for medications.

Eligibility

The Site and our services are intended for adults 18 years of age or older. By using the Site, you represent that you meet this requirement.

Not for Emergencies

The Site, our contact form, and our messaging are not monitored around the clock and must never be used to report a medical emergency. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.

Where We Provide Care

Ozark Men's Health is licensed to practice in Arkansas. Telehealth visits are available only to patients who are physically located in Arkansas at the time of the visit, and in-person visits take place at our Bentonville office. We are not able to establish care with patients located in other states.

How Medication Is Prescribed

Medication is prescribed only after a clinical evaluation by a licensed clinician, and only when it is medically appropriate for you. We do not prescribe on the basis of an online questionnaire alone. Testosterone is a Schedule III controlled substance and is prescribed in accordance with federal Drug Enforcement Administration requirements and Arkansas law. Completing an evaluation, paying a fee, or enrolling in a membership does not guarantee that any medication will be prescribed, and treatment may be declined, deferred, or discontinued on clinical grounds at any time.

Dispensing pharmacy. We do not sell, stock, or ship medication ourselves. Prescriptions mailed to patients are dispensed by Empower Pharmacy, a LegitScript-certified pharmacy: 7601 N Sam Houston Pkwy W, Ste 100, Houston, TX 77064 · (877) 562-8577. If a prescription is filled elsewhere, it is filled by a licensed pharmacy.

Compounded medications. Some of what we prescribe is prepared by a licensed compounding pharmacy rather than manufactured by a pharmaceutical company. Compounded preparations are not reviewed or approved by the U.S. Food and Drug Administration for safety, effectiveness, or manufacturing quality. Where both an FDA-approved product and a compounded alternative exist, we will tell you which one you are being prescribed and why; that choice is part of the clinical discussion during your visit, not something decided by price alone.

Individual Results Vary

Any description of outcomes on the Site is general information, not a promise of results. Response to testosterone therapy, weight-loss treatment, and our other services differs from person to person, and no specific outcome is guaranteed.

Fees, Membership Billing, and Refunds

Fees for evaluations, memberships, and add-on services are quoted to you before you enroll or are charged. All fees are for professional services, membership, and clinical time — they are not payment for medication.

Recurring membership billing. Memberships are billed automatically on a recurring basis, at the amount and interval disclosed to you when you enroll, using the payment method you provide, and continue until you cancel. There is no minimum commitment period.

Cancelling a membership. You may cancel at any time by giving us at least 30 days' written notice, by email to info@ozarkmenshealth.com or through the patient portal. Your membership and the services included with it remain active through the end of that 30-day notice period, and you will be billed for that period. We do not pro-rate or refund partial billing periods.

Refunds. Fees for services already provided are not refundable. A service is considered provided once any of the following has happened: your evaluation or consultation visit has taken place, laboratory testing has been ordered or collected, or a prescription has been transmitted to a pharmacy on your behalf.

If you decide not to move forward before any of those steps has occurred, contact us and we will review a refund of the unused portion of your fee case by case. We would always rather resolve a concern with you directly than have you dispute a charge, so please reach out to us first.

Missed appointments. Please give us at least 24 hours' notice if you need to reschedule. Repeated missed appointments without notice may result in a fee or in discontinuation of the membership.

Acceptable Use

You agree not to use the Site to: violate any applicable law; attempt to gain unauthorized access to our systems or another user's information; interfere with the Site's normal operation; or submit false, misleading, or fraudulent information through our forms.

The Site may link to third-party websites and services, including Quest Diagnostics, Access Labs, our patient portal and online scheduling platform, and our social media pages. We do not control and are not responsible for the content, policies, or practices of any third-party site.

No Warranty

The Site is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Governing Law and Venue

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Benton County, Arkansas, and you consent to the jurisdiction of those courts.

Right to Refuse or Discontinue Service

We may decline to accept a prospective patient, or discontinue an existing patient relationship, consistent with our professional and ethical obligations and applicable law.

Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, form the entire agreement between you and us regarding your use of the Site. You may not assign your rights under these Terms without our written consent.

Reporting a Side Effect or Adverse Event

If you experience a side effect, adverse reaction, or other safety concern related to a medication or treatment you received through our practice, contact us right away at (479) 446-6972 so we can address it as part of your care. If it is an emergency, call 911. You may also report adverse events involving a prescription medication directly to the FDA's MedWatch program at www.fda.gov/medwatch or 1-800-FDA-1088, and concerns about how a medication was dispensed to the pharmacy that filled it.

Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
